1. Introduction

Welcome to Follow Christ Daily (“App”, “Service”), a mobile application designed to help users incorporate Christian principles into their daily lives and follow Jesus more closely. Follow Christ Daily is owned and operated by Eudemonia Interactive, LLC, a company incorporated under the laws of the United States, with its principal office located at 455 E Eisenhower Pkwy, STE 300, Ann Arbor, MI 48108, United States (“Eudemonia”, “Company”, “We”, “Us”, or “Our”).

By accessing or using Follow Christ Daily, you, the user (“You”, “Your”), agree to be bound by these terms and conditions (“Terms”). If you do not agree to these Terms, you must not use Follow Christ Daily. Your use of Follow Christ Daily is also subject to our Privacy Policy, which outlines our policies and procedures on the collection, use, and disclosure of your personal information. Please read our Privacy Policy carefully before using Follow Christ Daily. By using Follow Christ Daily, you represent that you are over the age of 13 and that the Company does not permit those under 13 to use the App.

In these Terms, you will find information on the license to use Follow Christ Daily, subscriptions, user accounts, user content, intellectual property, feedback to the Company, third-party sites and links, termination, limitation of liability, disclaimer of warranties, governing law, dispute resolution, United States legal compliance, severability and waiver, changes to the terms, indemnification, and contact information. By using Follow Christ Daily, you agree to abide by these Terms and any changes that may be made to them.

2. License to Use

Eudemonia grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to download, install, and use Follow Christ Daily for your personal, non-commercial use, subject to these Terms.

You may not copy, modify, distribute, sell, or lease any part of Follow Christ Daily or attempt to extract its source code unless laws prohibit these restrictions or you have our written permission.

3. Subscription

A Subscription is required to use Follow Christ Daily. You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the type of Subscription plan you select when purchasing the Subscription. Your Subscription will automatically renew at the end of each period unless you cancel it or Eudemonia cancels it.

Subscriptions are managed through the App Store associated with your device. To cancel your Subscription, follow the steps provided in the App Store associated with your device. If canceled, your Subscription will continue until the end of your current billing cycle, but it will not be automatically renewed. Paid Subscription fees are non-refundable. You will be able to access the App until the end of your current Subscription period.

Eudemonia, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current Subscription period. Eudemonia will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective. Your continued use of Follow Christ Daily after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

Eudemonia may, at its sole discretion, offer a Subscription with a Free Trial for a limited period of time. You may be required to enter your billing information in order to sign up for the Free Trial.
If you do enter your billing information when signing up for a Free Trial, you will not be charged until the Free Trial has expired. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.

Eudemonia reserves the right to modify or cancel the Free Trial offer at any time and without notice. You agree that your purchases and Subscriptions are not contingent on the delivery of any future functionality or features.

4. User Account

When you create an account with Follow Christ Daily, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on the App.

You are responsible for safeguarding your password and for any activities or actions under your password. You may not use a username that is offensive, vulgar, or obscene or infringes on any rights of another person or entity. You agree to immediately notify Eudemonia if there is a breach of security or unauthorized use of your account.

5. User Content

Follow Christ Daily allows you to input User Content such as text and photos (“User Content”), which will remain private by default. You are responsible for the legality, reliability, and appropriateness of your User Content. By inputting User Content, you grant Eudemonia the right to use, store, and process it to provide the App’s services. You represent and warrant that the User Content is yours or you have the right to use it and grant Eudemonia the rights and license. You are solely responsible for User Content and all activity under your account.

Do not input User Content that is illegal, offensive, defamatory, spam, harmful, infringing, impersonating, violating privacy, or false. Eudemonia reserves the right to refuse or remove inappropriate User Content and limit or revoke your use of the App.
By using the App, you may be exposed to User Content that may be offensive, incorrect, or objectionable. You use the App at your own risk and Eudemonia is not liable for any User Content or damages incurred from use of the App.

Although regular backups of User Content are performed, Eudemonia does not guarantee there will be no loss or corruption of data. Eudemonia has no liability related to the integrity of User Content or the failure to successfully restore User Content to a usable state.

Eudemonia reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any User Content is appropriate and complies with this Terms, refuse or remove this User Content. Eudemonia further reserves the right to make formatting and edits and change the manner any User Content. Eudemonia can also limit or revoke the use of the App if you post such objectionable User Content.

6. Intellectual Property

Follow Christ Daily and its original content (excluding Content provided by you or other users), features and functionality are and will remain the exclusive property of Eudemonia and its licensors.

Follow Christ Daily and its logos are trademarks and registered trademarks of Eudemonia Interactive, LLC. in the United States and/or other countries. All rights reserved.

The content of Follow Christ Daily, including but not limited to text, graphics, photographs, images, and other material contained in Follow Christ Daily (collectively referred to as “Content”) is protected by copyright and other laws in both the United States and other countries. The Content is owned by Eudemonia Interactive, LLC. or its licensors, and is protected by copyright, trademark, and other intellectual property laws.

You may not modify, copy, distribute, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any Content or information obtained from Follow Christ Daily without the prior written permission of Eudemonia Interactive, LLC.

You may use the Content only for your personal, non-commercial use and you may not remove any trademark, copyright or other proprietary notices from the Content.
Eudemonia Interactive, LLC. reserves the right to enforce its intellectual property rights to the fullest extent of the law, including seeking criminal prosecution.

7. Your feedback to Us

You assign all rights, title and interest in any Feedback You provide Eudemonia. If for any reason such assignment is ineffective, you agree to grant Eudemonia a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.

8. Third-Party Sites and Links

Follow Christ Daily may contain links to third-party websites, which Follow Christ Daily has no control over. Follow Christ Daily is not responsible for the content, privacy policies, or practices of these third-party websites. We advise you to read their terms and conditions and privacy policies.

9. Termination

We may terminate your account immediately for any reason, including breach of terms and conditions. Upon termination, your right to use the service will cease.

10. Limitation of Liability

Follow Christ Daily and its creators shall not be liable for any damages, including without limitation, direct, indirect, incidental, special, or consequential damages, loss of profits, or for any other loss or damage of any kind, including but not limited to loss or damage arising from loss of data or business interruption, arising out of or in connection with the use of Follow Christ Daily, whether in an action in contract, tort, or otherwise, even if the Company has been advised of the possibility of such damages. The user acknowledges and agrees that the limitations of liability set forth in these Terms are fair and reasonable.

11. Disclaimer of Warranties

The App is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the App, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the App will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

12. Governing Law

This agreement and any dispute arising from or related to the use of the Follow Christ Daily app shall be governed by and construed in accordance with the laws of the state of Michigan, United States, without giving effect to any principles of conflicts of law. The parties agree to submit to the exclusive jurisdiction of the courts located in Ann Arbor, Michigan, United States for the resolution of any disputes arising from or related to this agreement.

13. Dispute Resolution

In the event of any dispute arising from or related to these Terms or the use of the Follow Christ Daily app, the parties agree to first try to resolve the dispute through negotiation. If negotiation does not result in a resolution, the parties may seek resolution through mediation or arbitration. The mediation or arbitration shall be conducted in accordance with the rules of the American Arbitration Association. The decision of the mediator or arbitrator shall be final and binding on the parties.

14. United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

15. Severability and Wavier

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

16. Changes to the Terms

We reserve the right to modify these terms at any time. By continuing to use the service, you agree to be bound by the revised terms. If you have any questions, you can contact Follow Christ Daily by email or mail.

17. Indemnification

The user agrees to indemnify and hold Follow Christ Daily, its creators, affiliates, licensors, and service providers harmless from any claims, damages, losses, liabilities, expenses, and costs (including but not limited to attorney’s fees) arising from or related to the user’s use of the app, or any violation of these Terms and Conditions by the user. The user agrees to cooperate fully in Follow Christ Daily’s defense of any such claims. Follow Christ Daily reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the user.
